Two years in the slammer for multiple drug charges

The Ontario Court of Justice, Criminal Division, convened in Pembroke on Tuesday, Jan. 22 at its Pembroke Street East location. Presiding were Justice Grant Radley-Walters and Justice Selkirk. Representing the Crown attorney’s office were Terri James, Sam Humphrey, Elizabeth Ives-Ruyter, Saad Syed and Federal Crown Tim McCann. After a number of adjournments, were sentenced.

• Richard Laronde, 58, of Pembroke, was sentenced to two years in prison after he pleaded guilty to a trafficking in a substance charge and a breach of recognizance charge. He previously pleaded guilty to four other trafficking in a substance charges, possession of property from the proceeds of crime and breaching conditions of his probation.

The accused had arranged for several drug transactions with undercover police officers between July 2011 and March 2012. Those transactions included sales of morphine, OxyCodone and marijuana in three communities including Petawawa, Pembroke and North Algona/Wilberforce.

On Dec. 1, 2011, he sold morphine to an undercover officer and on Jan. 18, 2013 he was observed by officers talking on a cell phone, although he was bound by a condition not to possess a cell phone. The officer called his number and when he answered the phone he was arrested.

Radley-Walters imposed a 10-year weapons prohibition and ordered Laronde provide a sample of his DNA.

• Kyle Brydges, 27, of Lindsay, Ont., pleaded guilty to three charges of trafficking in a substance and two counts of possessing property from the proceeds of crime.

Federal Crown McCann told the court that on March 3 and 10 and April 5, 2011 Brydges sold marijuana to undercover officers. On March 3 it was seven grams worth $50, on March 10 it was 7.5 grams worth $55 and on April 5 it was two grams worth $20.

Brydges’ lawyer Mark Huckabone told Selkirk his client is out of the drug business, has turned his life around and is remorseful.

Brydges received a six-month conditional sentence with the first four months to be spent under house arrest. He must abstain from the purchase, possession, consumption and use of alcohol and other intoxicating substances and he is not to associate with anyone known to have a record. Selkirk also imposed a 10-year weapons prohibition.

• Dale Bowers, 27, pleaded guilty to the charge of public mischief.

The court heard that on Oct. 22, 2012, Bowers called the Upper Ottawa Valley detachment of the Ontario Provincial Police to report his vehicle had been stolen. The vehicle was later discovered on its roof in the ditch near a 90 degree corner where Walsh and Blue Bird Roads meet in Laurentian Valley Township.

There were skid marks leading into the turn and extensive damage to the vehicle. It was learned that Bowers had been in a collision while leaving a party but abandoned the vehicle.

Before passing sentence, Radley-Walters cautioned Bowers that it is unacceptable to lie to the police after a night of drinking and rolling a vehicle and leaving it there for someone else to deal with.

He suspended the passing of sentence and placed Bowers on probation for 12 months. Bowers must also make a $300 charitable donation and provide proof of the donation to his probation officer.

• Joshua Jocko, 20, of 1062 Lea St., Pembroke, pleaded guilty to the charge of mischief under $5,000,

On Sept. 1, 2012 kicked the rear-view mirror off a vehicle and pulled on one of the windows causing it to shatter.

The damaged was estimated to be more than $1,000.

Jocko received a conditional discharge and was placed on probation for 12 months, during which time he must attend for assessment, treatment and counselling deemed necessary.

• Reid Boudreau, 57, of 19 Smith St., Apt. 101, Beachburg, pleaded guilty to the charge of theft under $5,000.

The court heard that between April 6 and Nov. 21, 2012 he stole $46 from a woman.

When the thefts were discovered, he immediately apologized.

Justice Radley-Walters suspended the passing of sentence and placed Boudreau on probation for 12 months. He must not associate with the victim and he was ordered to repay the $46.

• Leeanne Brisson, 44, of Arnprior, pleaded guilty to the charge of operating a motor vehicle with a blood-alcohol level over .08.

Just before 5 p.m. on Nov. 12, 2012, military police were on patrol when they observed a vehicle travelling at a high rate of speed down Menin Road. The vehicle was clocked doing 80 km/h in a 50 km/h zone, James told the court.

When stopped Brisson told the officer she was lost and didn’t realize how fast she was going. She avoided direct eye contact and had difficulty producing the necessary documents. When the officer asked if she had been drinking, Brisson admitted she had been.

Readings indicated Brisson had a blood-alcohol levels of .185 and .184 at the time the suitable samples were taken.

Radley-Walters expressed concern about the elevated readings, particularly because of the time of day.

Brisson was fined $1,800 and prohibited from driving for 12 months although after three months she can apply for the ignition interlock device program.

• Cody Nagle, 19, of 1914 Bromley Line, Westmeath, pleaded guilty to the charge of possession of a substance.

On Nov. 2, 2012 the Pembroke Police were alerted there may be an individual in the smoking area of an local high school with marijuana.

Plain-clothed officers began surveillance in an unmarked car around 11:30 a.m. when they observed Nagle with a group of other students. He produced a silver grinder from his pocket and proceeded to crouch down between the students with rolling paper and marijuana and roll a joint.

Police approached the group and arrested Nagle. The subsequent search resulted in the seizure of the grinder and a small amount of marijuana.

Nagle received a conditional discharge and was placed on probation for nine months, during which time he must abstain from the purchase, possession, consumption and use of illegal substances. He must not associate with anyone with a youth, criminal or controlled drugs and substances act record.

 

• James Mirault, 46, pleaded guilty to the charge of assault.

On Nov. 11, 2012 he slapped a woman in the face and shook her when several times when she tried to get away.

Mirault received a conditional discharge and was placed on probation for 12 months, during which time he must attend for assessment, treatment and counselling. He is not to have contact with the victim.

•Sean Sauve, 25, of Pembroke, pleaded guilty to the charge of possession of property.

On Jan. 20, 2012 around 8 p.m. Pembroke police received a complaint of a suspicious male trying car door handles in the area of Doran and McGee Streets.

Police located Sauve coming out of a car port on McGee Street near Murray and he appeared nervous. Police discovered he had stolen candy, lighters, cigarettes, a utility knife and a wallet containing Canadian Tire money. He showed the officers which vehicles he hit in the area of Doran, Miller and Renfrew Streets.

Sauve was sentenced to 30 days in custody, followed by 12 months probation, during which time he must abstain from the purchase, possession, consumption and use of alcohol and substances. He must attend for assessment, treatment and counselling and is not to enter any private motor vehicle unless the owner is present or he has the written consent of the owner.

• Kenneth McCann, 24, of 3902 Dundonald Dr. Petawawa, received a 90-day conditional sentence after he previously pleaded guilty to three charges of unauthorized possession of a weapon and careless storage of a weapon.

The first 60 days of the sentence are under house arrest. During the conditional sentence he must not carry any weapons.

He must abstain from the purchase, possession, consumption and use of alcohol and intoxicating substances.

McCann was also placed on probation for 12 months at the conclusion of his conditional sentence, during which time he must attend for assessment, treatment and counselling.
